1. Purpose & Scope
Vinix operates a multi-tenant telecommunications network serving thousands of business customers. The purpose of this AUP is to protect the integrity, performance, and availability of the Vinix network and services, protect other customers from harm, ensure compliance with applicable federal and state telecommunications laws and regulations, and establish clear expectations for responsible use.
This AUP applies to all Vinix customers, their employees, contractors, end users, and any other party who accesses or uses Vinix services through a customer account (“Users”). Customers are responsible for ensuring that all Users comply with this AUP. Vinix reserves the right to interpret and enforce this AUP in its sole reasonable discretion.
2. Prohibited Uses
The following uses of Vinix services are strictly prohibited:
2.1 Spam, Robocalling & Unsolicited Communications
- Sending unsolicited bulk voice calls (robocalls) to consumers without prior express written consent as required by the Telephone Consumer Protection Act (TCPA) and FCC regulations.
- Transmitting unsolicited bulk SMS or MMS messages (SMS spam) to recipients who have not opted in to receive communications from your organization.
- Using auto-dialers, predictive dialers, or pre-recorded message systems in a manner that violates TCPA, state do-not-call laws, or the FTC Telemarketing Sales Rule.
- Calling numbers on the National Do Not Call Registry or applicable state do-not-call lists without an established business relationship or written consent.
- Suppressing, spoofing, or misrepresenting caller ID information for the purpose of deceiving call recipients (illegal under the Truth in Caller ID Act).
2.2 Illegal Activity
- Using Vinix services to facilitate, plan, or execute any activity that violates applicable federal, state, or local laws.
- Transmitting content that is unlawful, threatening, harassing, defamatory, obscene, or that constitutes hate speech.
- Conducting or facilitating fraud, including wire fraud, telecommunications fraud, or impersonation of government agencies, financial institutions, or utilities (including IRS impersonation scams).
- Transmitting, distributing, or storing material that infringes copyrights, trademarks, trade secrets, or other intellectual property rights.
- Using the services in connection with illegal gambling, sale of controlled substances, or other activities prohibited by law.
2.3 Network Abuse
- Engaging in traffic pumping (also known as access stimulation) — artificially inflating inbound call volume to a number in order to generate access charges.
- Reselling Vinix services to third parties without prior written authorization from Vinix.
- Exceeding authorized usage levels in a manner designed to manipulate billing or abuse flat-rate pricing.
- Using Vinix services to provide telecommunications services to the public as a common carrier without disclosing such use and obtaining applicable regulatory authorizations.
2.4 Impersonation
- Impersonating any person, organization, or entity, including Vinix employees or support staff.
- Using caller ID spoofing to display a number you do not have authority to use, or to disguise the true origin of a call or message.
- Using phone numbers provisioned by Vinix for purposes other than the business purposes disclosed at account registration.
2.5 Copyright Infringement
- Distributing, reproducing, or publicly performing copyrighted content (including music used in hold queues, IVR systems, or call recordings) without appropriate licensing from ASCAP, BMI, SESAC, or other applicable rights organizations.
- Using Vinix services to facilitate piracy, unauthorized distribution of software, or other copyright-infringing activities.
3. Voice & SMS Requirements
3.1 STIR/SHAKEN & Caller ID Authentication
As an FCC-registered originating carrier, Vinix implements STIR/SHAKEN caller ID authentication on all applicable traffic. Customers are required to use only phone numbers that they have legitimate authority to use as the originating caller ID. Providing inaccurate caller ID information, or requesting that Vinix assign attestation levels that do not reflect actual call origination facts, is a violation of this AUP and may constitute a violation of federal law.
3.2 10DLC Registration for Business SMS
All customers sending application-to-person (A2P) SMS messages must register their brand and campaigns through The Campaign Registry (TCR) via the 10-digit long code (10DLC) process before sending A2P messages. Sending A2P SMS without proper 10DLC registration is prohibited and will result in message filtering by downstream carriers, regardless of whether Vinix has been notified. Vinix may assist customers in the 10DLC registration process, but responsibility for compliance rests with the customer.
3.3 TCPA Compliance
Customers using Vinix services for outbound voice or SMS marketing campaigns are solely responsible for compliance with the Telephone Consumer Protection Act (TCPA), including obtaining prior express written consent before initiating autodialed or pre-recorded calls or texts to wireless numbers. Vinix is not responsible for customers’ TCPA compliance and may cooperate with regulatory investigations related to customer traffic.
4. Network Integrity
The following activities are prohibited as they threaten the integrity and security of the Vinix network and other customers’ services:
- Denial of service: Launching or facilitating denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks against any target, including Vinix infrastructure.
- Unauthorized access: Attempting to gain unauthorized access to Vinix systems, other customers’ accounts, or any third-party systems using Vinix services as a vector.
- Security scanning: Conducting unauthorized port scans, vulnerability scans, or network reconnaissance against Vinix infrastructure or other customers.
- Malware distribution: Using Vinix voice or data services to distribute malware, ransomware, viruses, or other malicious code.
- VoIP fraud: Conducting SIP brute-force attacks, toll fraud, PBX hacking, or any other form of VoIP exploitation, whether targeting Vinix or any third party.
- Excessive resource consumption: Using an unreasonable or disproportionate share of network resources in a manner that degrades service for other customers.
5. Emergency Services (E911)
VoIP-based emergency calling (E911) has important differences from traditional landline 911 service that Customers must understand:
- Address registration required: E911 services route emergency calls based on the registered service address associated with your account. You must ensure that all service location addresses are accurately registered in the Vinix portal. Failure to maintain accurate E911 addresses may prevent emergency responders from locating the caller.
- Power and internet dependency: Unlike traditional landline service, VoIP requires functioning internet connectivity and power to place calls, including 911 calls. In the event of a power outage or internet disruption, E911 calling may be unavailable. Customers should maintain alternative means of contacting emergency services (such as a cellular phone) as a backup.
- Notification obligation: You are required to inform all employees, contractors, and visitors who may use your Vinix service of the limitations of VoIP 911 and the importance of having alternative emergency calling capability.
- No abuse of 911: Using 911 for non-emergency purposes, making false emergency reports, or using Vinix services to conduct swatting (making false emergency reports to send law enforcement to an address) is a serious violation of this AUP and a federal and state crime.
6. Enforcement
Vinix monitors its network for AUP violations using automated tools and human review. Upon detecting or receiving a credible report of an AUP violation, Vinix may take the following actions, at its sole discretion:
- Warning: For first-time or minor violations, Vinix may issue a written warning to the account administrator and require corrective action within a specified timeframe.
- Traffic blocking: Vinix may block specific types of traffic (e.g., outbound SMS, calls to specific destinations) pending investigation without suspending the entire account.
- Service suspension: For serious or repeated violations, Vinix may immediately suspend all or part of your service without prior notice. Vinix will notify you of the suspension and the reason as soon as practicable.
- Account termination: For severe violations (including illegal activity, fraud, persistent robocalling, and network attacks), Vinix may terminate your account immediately, without notice, and without refund of any prepaid amounts.
- Legal referral: Vinix reserves the right to refer violations to law enforcement and cooperate with investigations. Vinix will preserve evidence and comply with lawful legal process.
Vinix’s failure to enforce any provision of this AUP on one occasion does not constitute a waiver of its right to enforce that provision in the future.
7. Reporting Violations
If you believe that a Vinix customer is violating this AUP — including sending spam, conducting robocalls, committing fraud, or abusing the network — please report it to our abuse team:

When reporting a violation, please include as much detail as possible: the originating phone number, date and time of the incident, a description of the violation, and any supporting evidence (call recordings, screenshots, etc.). Vinix investigates all credible abuse reports.
